1. Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop www.nimori.de between NIMORI Franke & Thürnagel GbR (hereinafter "we" or "NIMORI") and the customer (hereinafter "you" or "customer").

1.2 Customers within the meaning of these General Terms and Conditions can be both consumers within the meaning of Section 13 of the German Civil Code (BGB) and entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB).

1.3 Deviating terms and conditions of the customer will not be recognized unless we expressly agree to their validity in writing.

3. Conclusion of contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

3.2 By completing the order process, you submit a binding offer to conclude a purchase contract for the goods contained in the shopping cart.

3.3 The contract is concluded when we accept your order by sending an order confirmation via email or by delivering the goods within 5 working days.

4. Prices and shipping costs

4.1 All prices are in euros and include VAT.

4.2 In addition to the stated prices, we charge a flat shipping fee of €5.95 per order within Germany. The shipping costs are clearly stated in the shopping cart system and on the order page.

5. Payment

5.1 Payment can be made by:

- PayPal

- Klarna (instant bank transfer, invoice, installment purchase)

- Credit card

- Apple Pay

5.2 If you select the payment method “Prepayment”, the goods will only be dispatched after receipt of payment.

5.3 The respective payment terms of the third-party providers (PayPal, Klarna, etc.) apply.

6. Delivery

6.1 Delivery will be made to the delivery address you provide within Germany.

6.2 Delivery is via DHL. Delivery time is approximately 2–5 business days, unless otherwise stated.

6.3 If there are any delays in delivery, we will inform you immediately.

7. Retention of title

The goods remain our property until full payment has been made.

8. Right of withdrawal for consumers

Consumers are entitled to the statutory right of withdrawal. Details can be found in our cancellation policy .

9. Warranty

9.1 The statutory liability for defects applies.

9.2 For businesses, the limitation period for claims for defects in newly manufactured goods is 12 months from the transfer of risk. For consumers, the statutory limitation period applies.

10. Liability

10.1 We are liable without limitation for damages resulting from injury to life, body or health as well as in the event of intentional or grossly negligent breach of duty.

10.2 Otherwise, our liability – regardless of the legal basis – is excluded unless mandatory statutory provisions conflict with this.

11. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR platform): https://ec.europa.eu/consumers/odr . We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final provisions

12.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

12.2 Should individual provisions of this Agreement be invalid or unenforceable or become invalid or unenforceable after conclusion of the Agreement, the validity of the remaining provisions shall remain unaffected.

12.3 The place of jurisdiction for all disputes arising from the contractual relationship is Munich, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.
